Man with Van Newington Terms and Conditions of Service

These Terms and Conditions set out the basis on which Man with Van Newington provides removal, transport and associated services within the United Kingdom. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions:

Customer means the person or organisation booking the services or on whose behalf the services are booked.

Services means any removal, transport, delivery, loading, unloading, packing, unpacking, storage, or related services provided by Man with Van Newington.

Vehicle means any van or other vehicle used to provide the services.

Goods means all items, property, furniture and personal effects which are the subject of the services.

Contract means the agreement between Man with Van Newington and the Customer incorporating these Terms and Conditions.

2. Scope of Services

Man with Van Newington provides man and van removal and transport services for residential and commercial customers within the UK. This includes, but is not limited to, local moves, small house and flat removals, office moves, item collections and deliveries, and related loading and unloading services.

The specific services, locations, timings, and any additional requirements will be agreed at the time of booking and confirmed by us. Any changes requested after booking may affect the price and availability of the services.

3. Booking Process

3.1 Bookings can be made by the Customer by contacting Man with Van Newington through an accepted communication method as advertised by us from time to time.

3.2 At the time of booking, the Customer must provide accurate and complete information, including but not limited to:

The collection and delivery addresses.

Property access details, including floor level, lift access, parking restrictions and distances from the Vehicle to the property.

A clear description and approximate volume or list of the Goods.

Any heavy, oversized, fragile or valuable items.

Required dates and times for the services.

Any special handling requirements.

3.3 Quotations are based on the information supplied by the Customer. If the information is inaccurate or incomplete, we reserve the right to amend or withdraw the quotation, adjust the price, or refuse to carry out some or all of the services.

3.4 A booking is only confirmed when Man with Van Newington explicitly accepts the booking and, where required, the Customer has paid any requested deposit or prepayment.

3.5 We reserve the right to decline any booking at our discretion.

4. Quotations and Pricing

4.1 Quotations may be provided as a fixed price or on an hourly rate basis. The type of pricing will be made clear to the Customer at the time of booking.

4.2 Unless otherwise stated, quotations are based on:

Reasonable access at both collection and delivery locations.

Use of standard moving equipment only.

Normal working hours.

A single trip between the agreed addresses.

4.3 Additional charges may apply if:

Access is restricted or differs from that described at the time of booking.

There are delays outside our control, such as waiting for keys or access.

Additional items or services are requested that were not included in the original quotation.

Parking fees, congestion charges, tolls, ferry charges or similar costs are incurred in providing the services.

4.4 Any estimate given based on time for completion is an approximation only and does not form a guarantee of completion within a particular period.

5. Customer Responsibilities

5.1 The Customer is responsible for:

Ensuring that they, or a designated representative, are present at the agreed addresses at the agreed times.

Providing clear and safe access to the property and ensuring that stairways, lifts and corridors are free from obstruction.

Arranging and paying for all necessary parking permits, permissions and vehicle access at both collection and delivery addresses unless otherwise agreed.

Packing and securing the Goods unless packing services have been expressly agreed as part of the services.

Ensuring that all Goods to be moved are ready for transport and properly labelled where necessary.

Complying with all relevant laws and regulations relating to the Goods and the premises.

5.2 The Customer must not ask our staff to carry out any illegal or unsafe acts, including but not limited to carrying prohibited items, breaching building rules, or lifting items beyond safe manual handling limits.

6. Payments and Charges

6.1 The Customer agrees to pay all charges for the services in accordance with the agreed quotation or pricing structure.

6.2 We may require a deposit or full prepayment at the time of booking. Any such requirement will be communicated before the booking is confirmed.

6.3 Unless otherwise agreed in writing, payment of any outstanding balance is due immediately on completion of the services on the day of the move.

6.4 Payment must be made using an accepted payment method as advised by Man with Van Newington. We are not obliged to accept cheques or any unapproved form of payment.

6.5 If payment is not made when due, we reserve the right to:

Charge reasonable interest on overdue amounts.

Suspend or refuse to provide further services.

Retain Goods until full payment is received, in accordance with our rights of lien under applicable law.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving notice to Man with Van Newington.

7.2 If the Customer cancels or significantly changes the booking on short notice, we may apply a cancellation charge. As a general guideline:

Cancellations made more than 7 days before the scheduled service date may be made without charge, except for any non-refundable costs already incurred by us.

Cancellations made between 48 hours and 7 days before the scheduled service date may incur a reasonable cancellation fee, which may include all or part of any deposit paid.

Cancellations made less than 48 hours before the scheduled service date may be charged up to the full agreed price for the services.

7.3 Any request to change the date, time, addresses, or scope of the services is subject to availability and may affect the price. We are under no obligation to accommodate requested changes but will make reasonable efforts to do so.

7.4 Man with Van Newington reserves the right to cancel or postpone the services in the event of circumstances beyond our reasonable control, including but not limited to extreme weather, vehicle breakdown, staff illness, accident, or safety concerns. In such cases, we will seek to rearrange the services at the earliest convenient time and any prepayments for unfulfilled services will be refunded or credited, but we will not be liable for consequential losses.

8. Excluded and Restricted Items

8.1 The Customer must not include in the Goods any items that are hazardous, illegal, dangerous or otherwise unsuitable for transport in a standard removal vehicle. Prohibited items include, but are not limited to:

Explosives, firearms, weapons and ammunition.

Flammable or combustible materials such as petrol, gas cylinders, solvents or paint thinners.

Chemicals, toxic or corrosive substances.

Waste materials not lawfully permitted to be transported in this way.

Stolen goods or items of unlawful origin.

8.2 We reserve the right to refuse to carry any item that we reasonably believe to be unsafe, illegal, excessively heavy, or beyond the capacity of our staff or Vehicles.

9. Packing, Handling and Access

9.1 Unless expressly agreed, our services do not include professional packing or unpacking. The Customer is responsible for ensuring Goods are properly packed and protected for transport.

9.2 If we agree to assist with packing, we will exercise reasonable care but are not liable for damage caused by poor quality packing materials supplied by the Customer or for items inherently fragile by nature.

9.3 The Customer must ensure that all items to be moved can be safely removed from and delivered into the relevant premises. This includes checking that items fit through doorways, hallways, staircases, lifts and other access routes.

9.4 We are not responsible for damage resulting from moving items which the Customer insisted on moving despite being advised that the item may not fit safely. In such cases, the Customer accepts all associated risks.

10. Waste, Disposal and Environmental Regulations

10.1 Man with Van Newington operates in accordance with applicable UK waste and environmental regulations. We are not a licensed household waste disposal contractor unless explicitly stated, and our standard services do not cover general waste removal.

10.2 We will not transport controlled waste, hazardous waste, or any materials that require specialist handling or licences, except where separately agreed and carried out in compliance with all applicable regulations.

10.3 If the Customer requests disposal of unwanted items, this must be agreed in advance as a separate service. Any such service will be provided in compliance with relevant waste transfer and disposal rules, and additional charges will apply.

10.4 The Customer is responsible for ensuring that any items handed to us for disposal are lawfully theirs to dispose of and are not prohibited or hazardous. The Customer will indemnify us against any claims, fines or penalties arising from unlawful or improper disposal instructions given by the Customer.

11. Liability and Limitations

11.1 We will take reasonable care in handling, loading, transporting and unloading the Goods. However, our liability is subject to the limitations set out in this section.

11.2 We are not liable for loss or damage where:

Such loss or damage arises from the Customer's failure to pack Goods properly.

Goods are inherently fragile or perishable, including but not limited to glass, china, electronics, plants or food, and damage is consistent with their nature.

Damage arises from incorrect instructions, incomplete information or misrepresentation by the Customer.

Damage arises from handling items which we advised may not be safely moved due to size, weight or access constraints, but which the Customer insisted on moving.

11.3 We are not liable for:

Loss of data or records stored on electronic devices.

Indirect or consequential losses, including loss of profit, loss of opportunity, or emotional distress.

Damage to premises or property other than the Goods, unless caused by our negligence. Where such damage occurs, the Customer must notify us in writing as soon as reasonably practicable.

11.4 Our total liability for loss of or damage to Goods, whether arising from negligence, breach of contract or otherwise, shall not exceed a reasonable market value of the Goods or any specific limit we have agreed in writing prior to the move, whichever is lower.

11.5 The Customer is encouraged to obtain appropriate insurance cover for the Goods during transport and handling. Man with Van Newington does not provide insurance advice and any insurance arrangements remain the responsibility of the Customer.

12. Claims and Notification of Loss or Damage

12.1 Any loss of or damage to Goods that is or should reasonably be apparent must be reported to us as soon as possible and in any event within 48 hours of completion of the services.

12.2 The Customer must provide reasonable evidence of the loss or damage and allow us a reasonable opportunity to inspect the Goods and assess the claim.

12.3 Failure to notify us within the specified time frame may affect our ability to investigate the matter and may reduce or extinguish any liability we may have.

13. Delays and Events Beyond Our Control

13.1 While we will make every reasonable effort to provide the services at the agreed time, we cannot guarantee arrival or completion times.

13.2 We are not liable for delays or failure to perform our obligations where such delays or failures are due to events beyond our reasonable control, including but not limited to traffic conditions, accidents, adverse weather, road closures, mechanical failure, or acts of third parties.

13.3 Where a delay occurs due to factors within the Customer's control, such as waiting for keys, lack of access or incomplete packing, we reserve the right to charge for waiting time at our standard rates.

14. Complaints

14.1 If the Customer is dissatisfied with any aspect of the services, they should raise the issue with our representative as soon as possible so that we have an opportunity to resolve it.

14.2 If a matter is not resolved at the time, the Customer should submit a written complaint giving full details of the issue and the service date. We will investigate and aim to respond within a reasonable period.

15. Data Protection and Privacy

15.1 Man with Van Newington will handle personal data provided by the Customer in accordance with applicable UK data protection laws.

15.2 Personal information will be used only for the purposes of administering bookings, providing services, handling payments and managing any queries or complaints, and will be retained only for as long as necessary for these purposes or as required by law.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any Contract between the Customer and Man with Van Newington shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms and Conditions or the provision of the services.

17. General Provisions

17.1 No variation of these Terms and Conditions shall be effective unless agreed in writing by Man with Van Newington.

17.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

17.3 No failure or delay by us in exercising any right or remedy shall constitute a waiver of that or any other right or remedy.

17.4 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between Man with Van Newington and the Customer in relation to the services and supersede any prior understandings, representations or agreements, whether oral or written.

By confirming a booking or using our services, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
